Trust & Probate Home Sales in Solano County | Golden Porch Group
For executors, trustees, and their attorneys

Selling a house for an estate has rules. We work inside them.

A trust sale, a probate sale under full authority, and a court-confirmed sale each work differently. We know which one you're in, what the court or the beneficiaries will expect, and how to document the sale so it holds up if anyone asks questions later.

Already working with an estate attorney? Good. We'll coordinate with them, not around them.

Which path are you on?

Four ways an estate home gets sold in California

Your attorney confirms which applies. Here's what each one means for the sale itself.

Trust sale

House held in a living trust

The successor trustee usually sells without going to court. Title companies typically ask for the trust, a death certificate, and a recorded affidavit. It sells much like a regular listing, but the trustee still owes beneficiaries a fair, well-documented sale.

Simplified petition

Primary residence up to $750,000

For deaths on or after April 1, 2025, a decedent's primary residence worth up to $750,000 may transfer through a shorter court petition instead of full probate (AB 2016). Heirs then sell it themselves.

Probate, full authority

Executor with full IAEA authority

The personal representative can generally sell without a court hearing, after giving beneficiaries a Notice of Proposed Action and time to object. Faster, but documentation matters.

Court-confirmed sale

Limited authority or court required

The accepted offer goes to a confirmation hearing, where other buyers can overbid. The price generally has to be at least 90% of the probate referee's appraised value. Buyers need to understand this up front, or they walk.

What we do differently

The parts of an estate sale a regular listing agent can miss

We price against the appraisal

We review the referee's appraisal and the comps, so the list price fits both the market and the court's requirements.

We prepare buyers for overbids

In a court-confirmed sale, we explain the hearing, the deposit, and the overbid process to buyers before they write an offer, which keeps them from walking.

We document everything

Pricing rationale, marketing activity, every offer received. You get a written record to give your attorney and the beneficiaries.

We keep beneficiaries in the loop

With your permission, we send simple progress updates so you're not fielding the same question from four relatives.

We handle the house, too

Lockbox, vacancy checks, cleanout, repairs that make sense, and vendors who know estate homes.

We show you an as-is option

When the house needs major work or the estate needs a fast, certain close, we'll show an as-is number alongside a market sale.

Two ways to sell

We'll put both options on paper. You choose.

Some estate homes are ready for market. Others need more work than the estate wants to fund. Here's how the choice looks on paper.

If you choose the as-is option, you're selling to a company she owns, and we'll put that in writing before you sign anything. You're welcome to have any as-is offer reviewed by your attorney, a family member, or another agent. If listing will net you more, we'll show you the numbers and tell you so.

Questions we answer with an estate attorney

We've worked with estate attorney David W. Knight on educational content for families going through trust and probate sales. If you don't have an attorney yet, we can introduce you. If you do, we'll work with yours.

We're not attorneys and don't give legal advice. You're free to use any attorney you choose.

  • Do I need court approval to sell this house?
  • Can I sell before probate is finished?
  • What does Notice of Proposed Action mean for the timeline?
  • Who pays for repairs and upkeep while it sells?
  • What if a beneficiary wants to buy the house?
  • How are sale proceeds handled until distribution?

Quick answers

Common questions

How long does a probate sale take?

It depends on the path. A sale under full authority can move close to a normal timeline once the notice period passes. A court-confirmed sale adds weeks for the hearing date. Full probate itself often takes a year or more, but the house doesn't always have to wait until the end.

Can a beneficiary buy the house?

Often, yes, but it needs to be handled carefully so the price is fair to everyone. Talk to your attorney first, and we can provide a value to start from.

Does the estate have to make repairs?

No. Many estate homes sell as-is. We'll tell you which repairs, if any, are likely to return more than they cost, and you decide.

What's an overbid?

In a court-confirmed sale, other buyers can show up at the hearing and bid more than the accepted offer, in set minimum increments. The court confirms the highest qualified bid.

Who pays your commission?

On a listing, the commission is paid from sale proceeds at closing, and in court-confirmed sales the court reviews it. On an as-is sale to Golden Porch of California, there's no listing commission.
